1. About These Terms
These Terms of Service ("Terms") govern your use of the Techbay Computer Specialists website at www.techbay.net.au ("the Website"), our online shop, and any related services provided by Techbay Computer Specialists ABN [ABN] ("Techbay", "we", "us", or "our").
By accessing or using the Website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website.
2. Customer Accounts
You may create an account to access features such as order history, saved addresses, and faster checkout. When creating an account, you agree to:

3. Online Shop & Orders
3.1 Product Information
We make every effort to ensure product descriptions, images, and pricing on the Website are accurate. However, we do not warrant that product descriptions or other content is error-free, complete, or current. If a product you have ordered is incorrectly described or priced, we will notify you and offer to cancel the order.
3.2 Pricing
All prices on the Website are in Australian Dollars (AUD) and include GST unless otherwise stated. We reserve the right to change prices at any time without notice, though any price changes will not affect orders that have already been confirmed.
3.3 Orders and Payment
When you place an order, you are making an offer to purchase. We may accept or decline your order at our discretion. Payment is processed securely by Shopify Payments. We accept major credit/debit cards, and other payment methods as displayed at checkout.
3.4 Shipping
Shipping costs and estimated delivery times are displayed at checkout. We are not responsible for delays caused by shipping carriers or customs. Risk of loss passes to you upon delivery to the carrier.
4. Consumer Guarantees & Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Nothing in these Terms limits or excludes those guarantees. You are entitled to:
- A replacement or refund for a major failure of goods, and compensation for any other reasonably foreseeable loss or damage
- Have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure
- Cancel a service that has a major problem or has it redone, and compensation for any other reasonably foreseeable loss or damage
5. Returns and Refunds
5.1 Change of Mind
We accept returns for change of mind within 14 days of delivery, provided the item is unused, in its original packaging, and in resaleable condition. Return shipping costs are the responsibility of the customer unless the item is faulty.
5.2 Faulty or Incorrect Items
If you receive a faulty, damaged, or incorrect item, please contact us within 7 days of receipt. We will arrange a replacement, repair, or full refund including return shipping costs, in accordance with your rights under the Australian Consumer Law.
5.3 Refund Process
Approved refunds will be processed to your original payment method within 5-10 business days.
6. Repair Services
When you book a repair service with us:
- We will provide a diagnosis and quote before commencing any paid work
- Our "No Fix, No Fee" policy applies — if we cannot resolve your issue, you will not be charged for the diagnostic
- Repair timeframes are estimates only and may vary depending on parts availability and complexity
- We are not responsible for pre-existing data loss; we recommend you back up your data before bringing your device in for repair
- Repair warranties cover the specific work performed and parts replaced, for a period specified at the time of service
7. Intellectual Property
All content on the Website — including text, graphics, logos, images, and software — is the property of Techbay Computer Specialists or its content suppliers and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written permission.
8. Limitation of Liability
To the maximum extent permitted by law and subject to your rights under the Australian Consumer Law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or our services
- Our total liability for any claim arising from or related to these Terms is limited to the amount you paid for the specific product or service giving rise to the claim
- We are not liable for any loss or damage caused by circumstances beyond our reasonable control
Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy, or any guarantee, warranty, or other term implied or imposed by legislation that cannot lawfully be excluded or limited.

Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the Australian Privacy Principles.
